Attorney Jill M. Bradley has practiced law since 1989, concentrating her practice in Family Law and Probate Law. She is admitted to practice in Massachusetts, the U.S. District Court, and the U.S. Supreme Court, having been admitted to the bar in December 1989.

Answers Before You Ask

In Massachusetts, spouses can separate without formal documentation. However, those needing financial support should file a “Complaint for Separate Support,” which allows judges to order support, custody, and visitation — but not property division.

A divorce complaint requests that judges make orders dividing real and personal property as well as liabilities, whereas separate support does not address property division.

An uncontested divorce involves parties in full agreement with the terms dissolving their marriage, with no waiting period. A contested divorce is filed when one party alleges the marriage’s irretrievable breakdown and the other opposes it; Massachusetts law ultimately grants divorces to the seeking party.

Uncontested divorces may take several months. Contested cases typically require a six (6) month wait prior to receiving a pretrial date, usually taking six months to a year or longer depending on complexity and county requirements.

Child support follows Massachusetts guidelines and isn’t tax-deductible or taxable. Alimony depends on the length of the marriage and need; it is tax deductible for the payor spouse and taxable to the recipient.

Costs vary by case complexity. Uncontested divorces are generally less expensive. Retainer fees are quoted after an initial free consultation.

While not legally required, having representation puts a party in a much stronger position.
